Do I Have a Case Against a Credit Bureau in Michigan? (7 Signs You May Qualify)

Do You Have a Credit Bureau Lawsuit in Michigan?

Many Michigan consumers may not realize they may have a legal claim for credit report errors or identity theft.
HERE ARE 7 SIGNS YOU MAY HAVE A STRONG CASE.

1. Accounts That Don’t Belong to You

Identity theft is one of the strongest claims and an identity theft lawyer can help you take the right steps to dispute identity theft credit report errors and to sue the credit bureau if necessary to fix your credit report.

2. You Disputed the Error—but Nothing Changed

If the credit bureaus ignored your dispute or did not correct the credit report errors,  this could be major red flag especially for credit report errors caused by identity theft.

3. The Bureau Verified False Information

This is one of the most common FCRA violations. If the credit bureaus verified inaccurate information on your credit report, or verified credit report errors caused by identity theft, this could also be another red flag.

4. Late Payments That Aren’t Your Fault

Sometimes even “technically correct” reporting can be misleading.  Common examples might include a creditor mishandling your payment or failing to account for your payment on your credit report.

5. You Were Denied Credit

Sometimes credit report errors, especially involving identity theft credit report errors, can lead to a denial of credit because of credit errors.
Common types of credit denials because of credit errors can include:
Mortgage denial
Car loan denial
Credit card denial

If you were denied credit because of a credit report error, you should dispute the errors with the credit bureaus or speak to a credit lawyer or identity theft lawyer.

6. You Sent Proof to the credit bureaus—and They Ignored It or did not fix your credit report

Credit bureaus must review documentation with your credit dispute and conduct reasonable investigations of consumer credit report disputes, including disputes involving identity theft credit report errors. In identity theft cases, the more documentation you provide to the credit bureaus, the better chance you have to fix the credit report mistakes.  Common documentation for identity theft credit report errors can include police reports and FTC Identity Theft Affidavits.

7. The Error Has Been There for Months

Sometimes credit bureaus will correct mistakes on your credit report, this can be either before or after you dispute the credit report errors. However, the longer the credit report error stays, the stronger your claim may be under the Fair Credit Reporting Act.

Michigan Consumers Have Strong Protections for credit report errors and identity theft

Under federal law, the Fair Credit Reporting Act, you may be able to  sue the credit bureaus and furnishers of credit information for credit report errors or identity theft credit report errors that the bureaus do not fix after your credit dispute:
 Experian
Equifax
TransUnion
